By using the Services, you represent that you:

Are at least 18 years of age, and
Have the authority to enter into these Terms on behalf of yourself or your business.

4. Accounts & Access

You may be required to create an account or provide access to your existing tools (such as calendars, CRMs, or phone systems) in order for us to deliver the Services.

You are responsible for:

Maintaining the confidentiality of any login credentials.
Ensuring that information you provide is accurate and up to date.
Any activity that occurs under your account or via your connected tools.

5. Acceptable Use

You agree not to use the Services for:

Sending spam, fraudulent, or misleading communications.
Harassing, threatening, or abusing customers or leads.
Violating applicable laws, regulations, or industry rules.
Attempting to reverse engineer, disrupt, or overload the Services.

We may suspend or terminate access if we reasonably believe these terms are being violated.

6. Billing & Payments

By subscribing to our paid plans, you authorize us (or our payment processor) to charge the applicable fees to your selected payment method on a recurring basis.

Setup fees and subscription fees are subject to our Refund Policy.

7. Cancellations

You may cancel your subscription at any time by contacting us at support@evotech.dev. Cancellations take effect at the end of the current billing period.

We may also terminate or suspend your access to the Services for violation of these Terms or non‑payment, with or without notice as permitted by law.

8. Data & Privacy

Our collection and use of personal information is described in our Privacy Policy.

By using the Services, you consent to our handling of information as outlined there, including data processed by our integrations with phone systems, calendars, and CRMs.

9. Third‑Party Tools & Integrations

Our Services may work together with third‑party providers such as CRMs, phone carriers, payment processors, and analytics platforms.

We are not responsible for downtime, data loss, or issues caused by third‑party tools or their terms of service. Your use of those tools is governed by their own policies.

10. Disclaimers

The Services are provided on an “as‑is” and “as‑available” basis. We do not guarantee any specific number of leads, bookings, revenue, or business results.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

11. Limitation of Liability

To the fullest extent permitted by law, EvoTech Automation will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly.

Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the Services in the three (3) months prior to the claim.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EvoTech Automation operates, without regard to conflict of law principles.
